Custody is often a hotly contested issue in divorce and paternity cases. There are many types of parenting plans that can be implemented that take into consideration what is best for your child.

When creating a parenting schedule, it is important to take into consideration the age of the child, extra-curricular activities, health issues, and distance between the parents’ homes. In some cases, when the parents cannot agree on what is best for the children, the court will appoint a Guardian Ad Litem (“GAL”) to conduct an investigation or evaluation. The expense is usually paid for by the parents. The GAL may be a social worker, doctor or lawyer. Their job is to meet with you and your children to help determine what is in their best interests. After meeting with everyone, and potentially speaking with collateral contacts, the GAL will file a report with the Court. The judge often uses the report in making his/her decision regarding custody if the parents are unable to reach an agreement.
